Item 4.
OWNERSHIP:

The information required by Items 4(a) - (c) is set forth in Rows 5 - 11 of the cover page for each Reporting Person hereto and is incorporated herein by reference for each Reporting Person.

The Company's Schedule 14A filed on July 6, 2011, indicates that the total number of outstanding shares of Common Stock as of January 2, 2012 was 26,617,369. In addition, the Company's Current Report on Form 8-K filed on January 19 ,2012 indicates that the underwriters with respect to the offering of 10,526,315 Units that closed on December 21, 2011, exercised their Over-Allotment Option with respect to 221,250 Units, each unit consisting of one share of Common Stock and one warrant to purchase 0.6 share of Common Stock. Furthermore, on March 16, 2012 the Company consummated the offering of 17,200,000 shares of Common Stock described in the Free Writing Prospectus filed on March 16, 2012, pursuant to which the Empery Funds purchased certain of the securities reported herein. The percentage set forth in Row (11) of the cover page for each Reporting Person is based upon such total number of shares of Common Stock outstanding and assumes the exercise of the reported Warrants subject to the 9.9% Blocker (as defined below).  Pursuant to the terms of the reported warrants (the “Reported Warrants”), the Reporting Persons cannot exercise any of the Reported Warrants until such time as the Reporting Persons would not beneficially own, after any such exercise, more than 9.9% of the outstanding shares of Common Stock (the "9.9% Blocker"), and the percentage set forth in Row (11) of the cover page for each Reporting Person gives effect to the 9.9% Blocker. Consequently, at this time, the Reporting Persons are not able to exercise all of the Reported Warrants due to the 9.9% Blocker.

However, pursuant to the terms of these Warrants, the Empery Funds cannot exercise any of these Warrants unless the Reporting Persons would not beneficially own, immediately after any such exercise, more than 4.99% of the outstanding shares of Common Stock (the "4.99% Blocker").  As of the date hereof, because of the 4.99% Blocker, the Reporting Persons do not beneficially own any shares of Common Stock underlying these Warrants.
